1. Acceptance of Terms

By accessing or using the BlackReef Holdings website and related corporate pages (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

We may update these Terms at any time. Continued use of the Site after any changes constitutes your acceptance of the revised Terms. We will indicate the "Last Updated" date at the top of this page when changes are made.

2. Relationship to App Terms

BlackReef Holdings may own, operate, or support individual applications that maintain their own websites, terms of service, privacy policies, support channels, and product documentation. These Terms apply only to this BlackReef Holdings corporate Site.

These Terms do not supersede, replace, modify, or override the terms of service, privacy policy, end user license agreement, subscription terms, or other legal terms published on an app's respective website or within that app. If separate terms apply to a specific app, those app-specific terms govern your use of that app.

3. Eligibility

The Site is intended for users who are at least 13 years of age. By using the Site, you represent that you are at least 13 years old. If you are under the age of majority in your jurisdiction, you may only use the Site with the involvement and consent of a parent or legal guardian.

4. Account Registration

This Site does not currently provide account registration. If an individual app offers account registration, account access, billing, or subscription features, please refer to that app's respective website and app-specific terms.

5. License to Use the Site

Subject to your compliance with these Terms, BlackReef Holdings grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute Site content except as expressly permitted
  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Site or related systems
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices

6. App Purchases and Subscriptions

This Site does not process app purchases or subscriptions. If an app offers purchases, subscriptions, paid features, refunds, trials, renewals, cancellations, or billing support, those matters are governed by that app's respective website, in-app terms, and applicable platform terms.

Nothing in these Terms changes, limits, or replaces any app-specific purchase, subscription, or platform terms.

7. User Conduct

You agree not to use the Site to:

  • Upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, or defamatory
  • Impersonate any person or entity or misrepresent your affiliation
  • Transmit spam, chain letters, or unsolicited communications
  • Introduce viruses, malware, or other harmful code
  • Interfere with the proper functioning of the Site or servers
  • Harvest or collect user data without authorization

8. Intellectual Property

All content, features, and functionality of the Site, including but not limited to text, graphics, logos, icons, images, and software, are owned by BlackReef Holdings or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights.

If you submit feedback, suggestions, or other content to us through the Site, you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate such content into our business without obligation to you.

9. Third-Party Services

The Site may link to third-party services, app websites, app stores, or other external resources. We are not responsible for the content, privacy practices, or reliability of any third-party service or separate app website. Your use of those services is governed by their respective terms and policies.

10. Disclaimer of Warranties

The Site is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BlackReef Holdings shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Site shall not exceed $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless BlackReef Holdings and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to us, our users, or third parties. App account termination, deletion, or support requests should be handled through the app's respective website or app-specific process. Upon termination, provisions that by their nature should survive will continue to apply.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any dispute arising from or relating to these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes may be subject to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Platform and App Terms

Apps may be distributed through third-party platforms or app stores and may be subject to additional platform terms, app-specific terms, license agreements, purchase terms, or subscription terms. Please refer to the app's respective website, in-app legal notices, and applicable platform terms for details.

These Site Terms do not supersede those app-specific or platform-specific terms.

16. Changes to the Site

We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice or liability. We may also impose limits on features or restrict access without notice.
